1. Parties and Purpose of Agreement

These Terms of Service and Service Agreement govern the terms of use for the flexapp.com enterprise portal, FlexApp Desktop Development Studio, and mobile applications developed on the FlexApp infrastructure.

All corporate users ("Customer" / "User") who access, download, install the desktop studio, or perform transactions via the portal agree to the terms contained herein.

2. Platform Definition and Scope of Service

FlexApp is an Enterprise No-Code engine and consultancy platform enabling organizations to design, compile, and manage their own mobile applications (iOS / Android).

  • FlexApp Desktop Studio: Desktop software where project designs, screen flows, and API integrations are built locally.
  • FlexApp Enterprise Portal (flexapp.com): Management hub accessed after login, containing My Projects, My Licenses, Access Control (RBAC) modules, Global Application Statistics, and download links for compiled APK / IPA files.
  • Mobile Runtime Engine: Infrastructure engine ensuring standalone execution of compiled applications and OTA (Over-The-Air) update tracking on devices.

3. Licensing and Usage Rights

Use of the FlexApp platform is subject to corporate licensing agreements:

  • License Grant: FlexApp grants Customer a non-exclusive, non-transferable, and limited right to use Desktop Studio and Enterprise Portal per agreement terms.
  • Device and User Limits: User permissions are configured via Access Control and My Licenses panels under flexapp.com. License rights cannot be leased, sold, or assigned to third parties.

4. Intellectual Property and Local .flx Project Files

FlexApp guarantees the independence of customer data and code architecture:

Ownership Belongs to Your Organization: All mobile project files, screen designs, workflows, and compiled APK/IPA packages developed using Desktop Studio are 100% Customer IP.

  • Local File Architecture (.flx): Project files generated in Desktop Studio are stored locally as .flx files. They are never sent to FlexApp servers unless explicitly committed by the developer.
  • No Cloud Dependency: Storing .flx project files on FlexApp servers is not required. Customers are free to use their own local version control systems (e.g. Git).
  • FlexApp Intellectual Property: Core software architecture, runtime engine libraries, and flexapp.com infrastructure belong to FlexApp. Reverse engineering or copying core engines is prohibited.

5. Direct API Connection and Standalone Guarantee

FlexApp commits to uninterrupted operations and zero-data interception via its core architecture:

  • Direct API Communication (Zero-Data Interception): Compiled mobile apps connect directly to Customer servers. FlexApp servers act neither as proxies nor interceptors; business data is never read or logged.
  • Uninterrupted Operations (Standalone Mobility): Even if central FlexApp servers or flexapp.com portal are unreachable, live mobile apps continue working seamlessly against Customer APIs.
  • Store-Independent Updates (OTA): Mobile apps check FlexApp servers upon launch solely to check for layout/screen updates (Version Control). No other data is transmitted.

6. User Obligations and Acceptable Use

Customer and authorized users agree to comply with the following rules:

  • Maintain secrecy and security of portal access credentials and user accounts.
  • Refrain from using the platform to develop unlawful, malicious, or rights-infringing apps containing malware.
  • Abstain from unauthorized penetration tests or hacking attempts against flexapp.com infrastructure.

7. Service Level Agreement (SLA) & Limitation of Liability

  • FlexApp exercises reasonable technical effort to maintain portal and OTA availability. However, FlexApp is not liable for issues originating from Customer backend/API infrastructure, ISP outages, or third-party store policies (Apple App Store / Google Play).
  • Because FlexApp servers do not intercept or store customer business data, FlexApp cannot be held liable for data loss occurring on Customer API servers.

8. Termination of Agreement

Parties may terminate services per terms outlined in the enterprise licensing agreement. Upon license expiration or termination, rights to build new releases via Desktop Studio cease; however, Customer retains full ownership of local .flx files and previously compiled standalone apps.

9. Amendments and Notifications

FlexApp reserves the right to update these terms to reflect technical infrastructure developments. Major updates will be announced via flexapp.com portal or authorized user emails.

10. Applicable Law and Contact Information
